Hi Twistina,

Just an idea, could you not ask you web / email provider to block his ip address and email address? send them copies of the emails as evidence as to why you want him blocked. Whatever you do, do not refund or he will have won.

It clearly states

The cooling-off period and your right to cancel

If you buy something without face-to-face contact, you will usually have a 'cooling off period' of seven working days. It lets you can cancel the order for any reason and get your money back.

If you decide to cancel your order within the cooling off period, you must tell the trader in writing.

You don't have this cancellation right:

    when a new service starts immediately (eg paying for access to a website)
    if the item is personalised or made to order
    if the item is perishable, eg food or flowers
    for newspapers or magazines
    where the security seal has been broken on a CD, DVD or computer software
    if you buy something from an online auction like eBay - this is known as a private sale

If you have already paid for the items or services, the trader must refund your money within 30 days of you cancelling the agreement
.

Also this part would be relevant:

When the cooling-off period starts

The seven working day cooling-off period usually starts on the day after you receive the goods.

But the trader has to tell you in writing:

    your right to a cooling off period
    how to cancel your order
    who is responsible for returning goods
    who has to pay the cost of returning goods if you cancel in the cooling-off period
    information about any after-sales service
    the address to use for complaints

If you don't get this information, your cooling-off period extends up to a maximum of three months and seven working days. For example if the trader takes one month to tell you in writing, you get a cooling-off period of one month and seven working days


So he is out of time to ask for a refund anyway :-) Throw the highlighted parts at him and he hasn't got a leg to stand on :-)


Another thought, When he says:
"I have given the matter thought today in anticipation of your email and I feel it is my moral obligation to warn people of not only purchasing this misleading products and additionally the poor customer service your response to my complaint has provoked, be it through word of mouth, internet forums etc."

If he does go ahead with this, it is basically SLANDEROUS and as long as you get proof of what he is saying / writing you would be able to take court action against him. LOTS of publicity for you in a GOOD way as I truly believe the positive comments from people on here represent just a tiny fraction of the support you will get from the much wider balloon twisting community :-)

Just an idea for anyone who releases instructional dvd's or cd's ... It might be advisable to put a security label on your products to prevent people trying to 'scam' you for a refund. In this day and age it's all to easy to copy dvd's and cd's.  Here's a link to a security label website //[color=#0000FF]http://www.labellock.com/dvd-security-labels.php[/color]
(no I have nothing to do with them, and I don't endorse them in any way, it's purely a quick search in Google for dvd security labels. Other company's that do similar products are available and maybe even cheaper)


Sorry this post is a bit jumbled, I'm still learning how to make things look neat and tidy.

I would hate to think he got a refund from his bully tactics.  I can see why you were so upset.  You care about doing a good job and pleasing your customers.  It goes to heart when someone does this.  You don't have any reason to refund this um.... person.  I wish I knew who it was so that I could make sure he didnt try to buy any of my pdfs.

I am sticking by my guns and all your guns too! :D He will certainly not be getting his money back for all the very valid reasons here. If he had had a genuine complaint and was reasonable in his request, I would not have hesitated to issue a refund.
If he chooses to carry out any of his threats, I am sure it is I who will be taking legal advice.

Thanks again everybody, I really am touched by the time you have taken to lend me your support and the infomation you have given me. You guys are the greatest!

Just picked the thread up, I agree with you all, TROLL who lives under blackpool tower. The designs are great (Purple Donkey is my fave) Well worth the price. I have them all printed off in full colour on my works printer!!! Although they dont know about it.  :D  :D

Oh dear - poor you, I've just found this - I'm with everyone else, ignore the idiot. I have your instructions and had no problems with any of them - the butterfly is a staple of my repertoire.

Hi Twistina,

I'd like to add my support as with everyone else. I certainly look up to you and your work, I love seeing what you do on here and FB. I also have this PDF (and others of yours) and yes, it can take a while the first time you make any of your designs, but once you've mastered them, they should take no more than five minutes to make. I use the 'Hello Kitty' 'Meerkat' and Dinosaur' regularly.

Twistina, I have purchased your pdfs and am totally happy with them.  That customer was extrememly rude and unfortunately there are people who will be like that no matter how good the product is that they have purchased.  I would not return his money either but also understand your concern with not doing so.  You have a good name in the balloon world and sell a very good product, please do not stop providing us newbies with the help we need.  It seems very strange to me that he also has waited so long to complain.  Maybe he should be directed to this forum to see how many of us, use and enjoy what you publish.

Oh how wicked some people are  :o  !

I think I know how you felt when you read  the email...
It's painful to receive such an unfair mail when you put all your heart in what you are doing.
Obviously they have a problem, and it's not related to your instructions I guess.

I second what has been said before : if they were too difficult for them, they should have told you straight away, and nicely !

Now, for being so unfair and rude, they don't deserve to get a refund. Let them twist swords and dogs, and if one day they realise that blaming others instead of practising leads nowhere, they will get back to your CD to learn  ;) .
